Welcome to Sara Technology, Inc. (“Sara,” “we,” or “us”)

These Terms of Service (“Terms”) govern your use of Sara’s services, including our websites, mobile apps, data files, visual tools, and any other platforms or software that link to or reference these Terms (collectively, the “Services”). Please review these Terms carefully before accessing or using any part of the Services.

In these Terms, “we,” “our,” and “Sara” refer to Sara Technology, Inc., the entity responsible for providing and maintaining the Services.

In order to use the Services, you must first agree to these Terms. If you are acting on behalf of a company, institution, or other entity, you represent that you have the authority to accept these Terms on its behalf. In such cases, “you” and “your” will also refer to that organization.

Children under the age of 18 may only use the Services with the supervision and consent of a parent or legal guardian. If you are a parent or guardian and you allow your child to use the Services, you agree to these Terms on behalf of your child. If you are using the Services with a child who is not your own, you must ensure that the child’s parent or legal guardian has provided verifiable consent.

You acknowledge that your decision to use or purchase access to the Services is not based on any future features or public comments from Sara or its representatives regarding potential enhancements or product development.

If you have a separate written agreement with Sara regarding your use of the Services, the terms of that agreement will govern to the extent there is any conflict with these Terms, but only with respect to the specific Services covered by that agreement.

Important Notice Regarding Arbitration

Except where prohibited by law or otherwise stated in these Terms, any dispute between you and Sara will be resolved through binding individual arbitration. You also waive your right to participate in a class action lawsuit or class-wide arbitration. Please read the arbitration section below for details.

BY ACCESSING, INSTALLING, DOWNLOADING, PURCHASING, OR USING THE SERVICES OR ANY ASSOCIATED CONTENT, YOU ARE AGREEING TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE OR ACCESS THE SERVICES.

Some features of the Services may have their own terms, policies, or usage rules. If those conflict with these Terms, the specific terms applicable to those features will govern your use of them.

1. Description of Services

Sara provides access to a digital application (the "Sara App") designed for parents and caregivers to support their child's speech practice at home.

Both apps deliver interactive articulation activities, real-time feedback based on children's speech, and tools to monitor progress. With your verifiable consent, the apps may capture brief audio recordings during use to provide personalized feedback and improve Sara’s speech recognition models. These recordings are used solely for purposes such as providing real-time playback features, analyzing articulation proficiency, identifying articulation errors, and improving our models for all users. Audio recordings, with explicit consent, may be used to help improve our AI models, enabling more accurate articulation detection and a more personalized experience for all users over time.

In some activities, the app may also access the device’s camera to provide real-time visual comparison (e.g., mirroring the user's mouth shape), but these video recordings are never uploaded or stored by Sara. They remain only on the local device and are automatically deleted after each session.

Sara does not share this data with third parties for advertising or commercial purposes.

Some features may be limited depending on device type or operating system. If you access the Services over a mobile network or while roaming, your wireless provider may charge data or roaming fees.

The Services are intended solely for educational and practice support purposes and are not a substitute for professional evaluation, diagnosis, or treatment.

Audio recordings, if captured, are encrypted and stored securely. They are never shared with third parties for advertising or promotional use.

2. Who Can Use Sara

Sara is designed for use by parents, legal guardians, and children ages 4–13. Children may use the Services only under the supervision of a parent or guardian who creates an account and provides verifiable parental consent in accordance with COPPA and other applicable laws.

Only parents or legal guardians may create an account for a child and must provide verifiable consent before the child uses the Services. Others may not use the Services with children without proper consent from the child’s legal guardian.

3. Your Account and Credentials

You may be required to create an account and provide certain information such as your name, email, phone number, billing address, payment method, child’s first name, grade, and interests ("Credentials"). You are responsible for maintaining and protecting your Credentials.

You are solely responsible for any activity using your Credentials, whether or not you authorized that activity. If your contact information or Credentials change, you must update your account promptly. Notify Sara immediately at support@saraspeech.com of any unauthorized use or breach of security. We may disable or suspend access to your account if we believe it has been compromised or misused.

4. Parental Consent, User Consent, and Children’s Data

Sara collects and processes children’s data only after obtaining verifiable parental or legal guardian consent, in accordance with COPPA and applicable laws. This may include:

Parent-supplied data (e.g., child’s name, grade, birthday month/year)
Audio recordings for speech practice (only with explicit consent)
App usage metrics to enhance experience and performance
User-generated content (e.g., recordings or activity submissions through the Services)

With consent, audio recordings and user consent may be used to:

Provide playback and personalized feedback
Analyze articulation proficiency and detect common errors
Customize speech detection to the child’s speech patterns
Analyze usage patterns and inform product improvements

Verifiable consent must come directly from the child’s parent or legal guardian. The Services are not designed for use by third-party providers or institutions at this time.

You remain responsible for any content you upload, transmit, or create through the Services ("User Content"). By submitting content, you grant Sara a non-exclusive, royalty-free, worldwide license to use it solely for the purposes outlined above.

User Content is not shared publicly and is never used for advertising. We may remove content that violates these Terms or applicable law, or that is no longer needed. Content may be deleted upon account termination and may not be recoverable.

We do not use children’s data for targeted advertising. We also do not share or sell personal data for marketing purposes. We do not use, disclose, or allow access to children’s personal information for behavioral advertising or tracking purposes.

We may aggregate anonymized usage data across users to evaluate platform performance and guide product development. Aggregated data does not identify individuals.

Parents may request deletion of their child’s data at any time by contacting support@saraspeech.com or, where available, using the data deletion option provided directly within the app. We will comply promptly unless retention is required by law or for legitimate operational purposes.

5. Subscription and Payments

Sara offers paid subscriptions. Pricing and plan options are listed in-app or on our website. Subscriptions may be processed via:

App Stores (e.g., Apple App Store, Google Play, or others): Payments, renewals, and cancellations are governed by the respective platform’s terms. You must manage these subscriptions directly via your account settings on the relevant app store.
Stripe (Direct Purchase): Certain plans may be prepaid using Stripe. By using this option, you authorize us to process payments through Stripe, subject to their terms: https://stripe.com/us/legal.

Free trials may be available. If not canceled before expiration, your payment method will be charged. Subscriptions auto-renew unless canceled before the renewal date. Cancellation stops future billing but does not result in refunds. Refunds may be granted only where required by law or in cases of documented billing errors.

You are responsible for keeping your payment method updated and for all applicable taxes. Unauthorized use must be reported promptly.

We are not liable for accidental or unauthorized purchases made through your account, including those by minors, though we will use reasonable efforts to address reported incidents. If a dispute arises regarding billing, you agree to notify us within 30 days of the charge date.

In-app purchases may be available within the Sara App. These will be clearly marked and require user confirmation before processing. Users should ensure that child-accessible devices are properly secured to prevent unintended purchases.

6. Use Restrictions

Rent, lease, sublicense, resell, or otherwise make the Services available to third parties, nor use the Services on behalf of or to provide services to others.
Access or use the Services in a way that seeks to circumvent applicable fees, usage limitations, or subscription terms.
Use the Services for competitive purposes, including but not limited to developing or offering a similar or competing product or service, or for the purpose of asserting intellectual property claims against Sara.
Use automated tools such as bots, scrapers, crawlers, spiders, or other data harvesting methods to extract, copy, or index content from the Services.
Upload, distribute, or otherwise make available any content through the Services that:
- Promotes or incites illegal activities or violence;
- Infringes upon the intellectual property, privacy, or publicity rights of others;
- Is deceptive, misleading, or impersonates any person or organization;
- Contains abusive, obscene, defamatory, harassing, hateful, or otherwise objectionable material;
- Is directed at or harmful to children;
- Includes viruses, malware, or any harmful or disruptive code;
- Violates any applicable laws, rules, or regulations; or
- Uses visuals or videos from the Services in a misleading, unauthorized, or harmful way, including sharing outside the platform without consent.

For your safety and the safety of others, you should not use the Services in situations where you are operating machinery, driving, or performing other tasks that require your full attention.

7. Privacy and Data Security

Sara complies with applicable U.S. privacy laws including COPPA, and makes good faith efforts to follow best practices aligned with state-level privacy standards such as the California Consumer Privacy Act (CCPA) where applicable.

We prioritize user privacy. Data is encrypted in transit and at rest, and we follow industry best practices for storage and access control.

We do not sell personal data. We only share information with third-party service providers (e.g., Apple, Stripe) as necessary to operate the Services. Use of these providers is subject to their respective terms.

8. Modifications and Termination

Sara is continually improving the Services to enhance your experience. You acknowledge and agree that the structure, functionality, features, and offerings of the Services may change over time without prior notice. These changes may include, but are not limited to, security updates, new features, feature removals, user interface adjustments, and modifications to pricing or billing practices. Unless otherwise specified, all modifications will be subject to these Terms.

You may terminate your use of the Services at any time by canceling your account or subscription. Cancellation does not entitle you to any refund for payments already made unless required by law. If you cancel a subscription, your access will continue for the remainder of the billing period already paid for.

Sara reserves the right, in its sole discretion and without notice, to suspend, restrict, or terminate your account or access to the Services for any reason, including but not limited to violations of these Terms or applicable law. If your account is terminated, we may delete your data and User Content. Where feasible, we will attempt to provide reasonable notice or an opportunity to export your content prior to deletion.

Upon any termination of your account or the Services, these Terms will also terminate; however, any sections that by their nature should survive termination (such as ownership rights, warranty disclaimers, limitations of liability, dispute resolution, and indemnity) shall remain in effect.

9. Disclaimers

Sara provides educational support tools only. We do not provide clinical or diagnostic services and make no warranties regarding the suitability of the Services for any specific therapeutic, medical, or educational purpose. Always consult professionals for individualized support.

Sara does not currently offer the Services for institutional or clinical use at this time. They are intended solely for use by families at home.

As noted above, the Services are not a substitute for professional evaluation, diagnosis, or treatment. Always consult a qualified clinician for individualized support.

Services are provided “as is” without warranties of any kind.

10. Limitation of Liability

To the extent permitted by law, Sara is not liable for indirect or consequential damages. Our maximum liability for any claim shall not exceed $150 or the amount you paid to us in the 12 months prior.

11. Dispute Resolution

These Terms are governed by Delaware law. All disputes will be resolved through binding arbitration with JAMS in Wilmington, Delaware.

You waive any right to participate in a class action. You may opt out of arbitration within 30 days by contacting us at support@saraspeech.com.
